1. PARTICIPATION AND EXCLUSIVITY

(1) The Jack Wolfskin Loyalty Programme (hereinafter referred to as " Jack Wolfskin Loyalty Programme") is operated by Jack Wolfskin Retail GmbH, Jack Wolfskin Kreisel 1, 65510 Idstein/Ts., Germany (hereinafter referred to as Jack Wolfskin). You (hereinafter referred to as "you", "your" or "participant") have the opportunity to participate in the Jack Wolfskin Loyalty Programme in accordance with the following conditions of participation. By registering for the Jack Wolfskin Loyalty Programme, you agree to the following conditions of participation.

(2) Any natural person who is a resident in a member state of the European Union, the United Kingdom or Switzerland and has reached the age of 18, is entitled to participate in the Jack Wolfskin Loyalty Programme. The Jack Wolfskin Loyalty Programme is aimed exclusively at private customers. Commercial customers are excluded from participating in the Jack Wolfskin Loyalty Programme.

(3) If you participate in the Jack Wolfskin Loyalty Programme, you can collect bonus points when you shop in the official Jack Wolfskin online shop. To collect points, you need to have a Jack Wolfskin Loyalty customer account. To do this, you must identify yourself as a Loyalty Member in the online shop. You can register for the Jack Wolfskin Loyalty Programme directly via the Jack Wolfskin website.

(4) So that we can credit the bonus points collected to your loyalty membership account, we require a participation form completed by you by means of an online registration (at https://www.jack-wolfskin.co.uk/loyalty/). Please inform us of any changes to the data you provided when registering in writing or by e-mail to info@jack-wolfskin.com.

(5) Bonus point vouchers issued as part of the Jack Wolfskin Loyalty Programme are sent exclusively by e-mail. To register for the Jack Wolfskin Loyalty Programme, it is essential to provide a valid e-mail address.

(6) Part of the Jack Wolfskin Loyalty Programme offer is also to inform all participants about our special promotions, offers and news (regularly by e-mail). As part of these conditions of participation, by participating in the Jack Wolfskin Loyalty Programme you agree to be informed about promotions, offers and news via e-mail newsletter. You can unsubscribe from the newsletter at any time with effect for the future by clicking on the unsubscribe link in the email or by sending us an email to datenschutz@jack-wolfskin.com.

(7) A prerequisite for participation in the Jack Wolfskin Loyalty Programme is the provision of your personal data, which must be provided as a mandatory field in the Jack Wolfskin Loyalty Programme registration form. It is not possible to participate in the Jack Wolfskin Loyalty Programme without providing this personal data.

(8) The Jack Wolfskin Loyalty Programme can currently only be used in Germany, Austria, the United Kingdom, and Switzerland.

2. COLLECT BONUS POINTS

(1) Every time you purchase bonus-eligible goods in the official Jack Wolfskin online shop, you will receive bonus points credited to your personal customer account (see section 3). The number of bonus points is calculated from the respective purchase price of the bonus-eligible products including the statutory VAT (assessment basis). You will receive 5 bonus points in the official Jack Wolfskin online shop for each full currency unit (e.g. GBP) of the basis of assessment. You will not be granted a bonus for the purchase of vouchers, services, or items from third-party manufacturers (secondary range) or for any shipping costs incurred.

(2) If a purchase contract is cancelled (return, complaint, etc.), the corresponding credit will be deducted from your bonus credit. If a bonus points voucher (section 3.) has already been issued to you or redeemed by you including the credit balance, a possible negative balance will be recorded in your customer account and offset against bonus points subsequently awarded from later purchases of goods.

(3) As a participant in the Jack Wolfskin Loyalty Programme, your orders and returns in the official Jack Wolfskin online shop entered via the customer account, registered for the Loyalty Programme are free of shipping costs.

3. BONUS POINTS CUSTOMER ACCOUNT

(1) Your bonus points are credited to a personal customer account managed by Jack Wolfskin on an ongoing basis and can be accessed online at any time in the "My Account" area.

(2) You can check the status of your bonus points in your customer account registered via the Loyalty Programme. Objections to the current points balance must be made in writing within 2 weeks of becoming aware of the credit balance, stating the Jack Wolfskin customer card number, and enclosing the relevant proof of purchase. Failure to make a claim in good time shall be deemed to constitute approval of the credit balance.

(3) Jack Wolfskin determines the points balance of your bonus points customer account at 4 points in the year (1 March, 1 June, 1 September, 1 December).

(4) If your bonus point balance is at least 1000 points at this time (corresponds to a purchase value of at least 200.00 units of the local currency (e.g. GBP) including VAT when shopping in an official Jack Wolfskin online shop), you will receive a voucher in the amount of 10.00 currency units. This will only be sent to you by e-mail. If you have collected a multiple of 1000 points, you will receive a further 10.00 on your bonus points voucher for each additional full 1000 points. Bonus points that have not been converted into bonus point vouchers and have not expired, will remain in your customer account, and will be carried over to the next billing period.

(5) The relevant period for determining the bonus points balance at the time of billing is the previous 12 months of your membership. Bonus points from purchases made more than 12 months ago for which no bonus points voucher could be issued, expire and are automatically deducted from your customer account.

4. EXCLUSIVE LOYALTY PROGRAMME - BENEFITS AND REDEMPTION OF BONUS POINT VOUCHERS

(1) As part of the Jack Wolfskin customer card programme, we offer you exclusive promotions and events. These can be discounted services, pre-sale promotions, exclusive events, or other interesting offers.

(2) Bonus point vouchers can only be redeemed in the country in which the points were generated. Bonus point vouchers are valid for 6 months after issued and must be entered correctly in the corresponding entry field in the official Jack Wolfskin online shop as part of the order entry process.

(3) Each bonus point voucher can only be redeemed once and for the total amount of the voucher. If the voucher amount exceeds the purchase amount at the time of redemption, the remaining voucher value expires. Bonus point vouchers expire automatically if they are not redeemed within the validity period. Cash payment of the voucher value or any remaining value after offsetting is excluded. Vouchers cannot be redeemed by telephone.

(4) If a purchase contract is cancelled in full (return, complaint, etc.) and a bonus points voucher has been redeemed, the voucher expires. In this case, you will be refunded the purchase amount (value of goods minus the voucher amount used).

5. USE OF YOUR DATA AND DATA PROTECTION

We inform you about the processing of your personal data in the customer account in our privacy policy.

6. CANCELLATION AND DELETION OF THE LOYALTY PROGRAMME ACCOUNT

(1) This agreement is concluded for an indefinite period. You can cancel your participation in the Jack Wolfskin Loyalty Programme at any time without notice by writing to Jack Wolfskin Retail GmbH, Jack Wolfskin Kreisel 1, 65510 Idstein/Ts., Germany or info@jack-wolfskin.com. Points that have not been redeemed expire at the end of your participation in the Loyalty Programme.

(2) Jack Wolfskin may terminate this agreement at any time by giving one month's notice. In this case, Jack Wolfskin will determine the loyalty credit balance on the cancellation date and, if the participant has a loyalty card balance of at least 1000 bonus points, a bonus points voucher in accordance with point 3. will be issued for the corresponding amount, and the loyalty card account will then be deleted.

(3) In the event of good cause, e.g. misuse of the Jack Wolfskin Loyalty Programme by the participant, Jack Wolfskin may terminate the contractual relationship with you at any time without observing a notice period. Jack Wolfskin reserves the right to claim all damages for misuse of the Jack Wolfskin Loyalty Programme.

(4) If you have not earned any new bonus points for a period of 10 years and the customer account has not been used by you (i.e. was inactive), Jack Wolfskin will delete your loyalty account without further notice. However, you can register again free of charge at any time.

7. LIABILITY

(1) Jack Wolfskin accepts no liability for the availability of the Jack Wolfskin Loyalty Programme at all times or for the completeness, accuracy and up-to-datedness of the bonus point balances, information and offers shown. The liability of Jack Wolfskin for the loss of bonus point vouchers is excluded to the extent permitted by law.

(2) Otherwise, we shall only be liable for such damages that are based on an intentional or grossly negligent breach of duty by legal representatives or vicarious agents of Jack Wolfskin. This limitation of liability shall not apply to damages resulting from injury to life, limb, or health.

(3) We shall not be liable for simple negligence on the part of legal representatives and vicarious agents of Jack Wolfskin unless an obligation is breached whose fulfilment is of particular importance for achieving the purpose of the contract (hereinafter referred to as a "cardinal obligation"). Cardinal obligations are obligations whose fulfilment is essential for the proper performance of the contract, whose breach jeopardises the achievement of the purpose of the contract and on whose compliance the other party to the contract regularly relies. In the event of a negligent breach of a cardinal obligation, liability is limited to the foreseeable damage typical of the contract.

(4) Liability under the Product Liability Act remains unaffected.

(5) We expressly point out that the contractual provision of the offers and services of the customer account depends crucially on the truthfulness of your personal details. Liability for damages based on your incorrect or incomplete information is therefore excluded.

8. FINAL PROVISIONS

(1) Jack Wolfskin reserves the right to discontinue the Jack Wolfskin Loyalty Programme in whole or in part at any time or to change its terms and conditions, in particular, if required by law or if this is necessary to improve processing or prevent abuse. Jack Wolfskin also expressly reserves the right to change the Loyalty Programme and bonus point calculation and redemption rules at any time.

(2) Changes will be communicated to you in writing to the last e-mail address provided or in your loyalty account as a message, and are deemed to have been approved if the participant does not object to Jack Wolfskin within one month of receiving the notification. If you object to the changes, Jack Wolfskin is authorised to terminate this agreement and delete your customer account. If you continue to use the Loyalty Programme after the deadline has expired, this shall also be deemed to be approval of the changes.

(3) This agreement on the Loyalty Programme is subject exclusively to German law. If you have your domicile or habitual residence in another EU member state at the time of the conclusion of the respective contract, the application of mandatory statutory provisions (in particular, consumer protection regulations) of this other state shall remain unaffected by the above choice of law. For all disputes arising from this agreement, including those concerning its valid conclusion and cancellation, the statutory place of jurisdiction shall apply.
