- PARTICIPATION AND EXCLUSIVITY
(1) The Jack Wolfskin Outdoor Community Membership Programme (hereinafter referred to as “Jack Wolfskin Membership Programme”) is run by Jack Wolfskin Retail GmbH, Jack Wolfskin Kreisel 1, 65510 Idstein/Ts., Germany (hereinafter referred to as Jack Wolfskin). You (hereinafter “you”, “your” or “Member”) can participate in the Jack Wolfskin Membership Programme in accordance with the following terms of participation. By signing up for the Jack Wolfskin Membership Programme, you agree to the following terms of participation.
(2) Any natural person who is resident in a Member State of the European Union, the United Kingdom or Switzerland and has reached the age of 18 is entitled to participate in the Jack Wolfskin Membership Programme. The Jack Wolfskin Membership Programme is intended solely for private customers. Commercial clients, employees of Jack Wolfskin or the Jack Wolfskin Stores are not eligible to participate in the Jack Wolfskin Membership Programme. The Jack Wolfskin Membership Programme may only be used in Germany, Austria, Switzerland and the United Kingdom.
(3) Participation in the Jack Wolfskin Membership Programme is free of charge. You can sign up for the Jack Wolfskin Membership Programme via the Jack Wolfskin website. To register, please complete the registration form at https://www.jack-wolfskin.co.uk/community. Please let us know in writing or by e-mail to info@jack-wolfskin.com of any changes to personal data provided during registration or please make changes to the details yourself in your membership account.
(4) To take part in the Jack Wolfskin Membership Programme, you are required to provide personal details specified as a mandatory field in the Jack Wolfskin Membership Programme registration form. It is not possible to take part in the Jack Wolfskin Membership Programme if these personal details are not provided. A valid e-mail address is mandatory.
(5) By signing up for the Jack Wolfskin Membership Programme, a personal membership account managed by Jack Wolfskin will be created for you, which you can view online at https://www.jack-wolfskin.co.uk/login.
(6) Part of the Jack Wolfskin Membership Programme also includes informing all members about our special promotions, offers and news (by e-mail on a regular basis). By participating in the Jack Wolfskin Membership Programme, you agree to Jack Wolfskin notifying you about promotions, offers and news in newsletters sent by email. By clicking on the unsubscribe link in the email, you may, at any time, unsubscribe from receiving newsletters with immediate effect into the future, or simply send an email to datenschutz@jack-wolfskin.com.
(7) Participation in the Jack Wolfskin Membership Programme also includes the analysis of your personal details for market research purposes, as we wish to use the knowledge gained from this both to constantly improve our services for you and to optimally adapt our services to your needs and requirements. To this end, we process customer data that includes, but is not limited to, email addresses from various sources such as our Customer Relationship Management (CRM) database and the Customer Data Platform (hereinafter: “CDP”) to improve our marketing measures and your customer experience by providing personalised advertising, services and offers. In this context, we pass on personal details (such as email address, first name and surname) received as part of you signing up for our Membership Programme to our CDP provider:

To undertake customer matching and the display of personalised advertising, we create so-called customer match lists where your data may be passed on by Bloomreach to our partners. Encrypted ("hashed") user data (email address, telephone number, postal address, customer-specific identifiers) are transmitted to and uploaded by our partners so they can apply customer match lists. Our partners then compare the transmitted user data to their existing data, to see if it matches. In turn, target groups can be created from these for managing adverts/campaigns. The process of synchronising data can take up to 48 hours. Once the comparison has been done and compliance check completed, your data is deleted.

- EXCLUSIVE MEMBERSHIP PROGRAMME BENEFITS
(1) As part of the Jack Wolfskin Membership Programme, we offer you a variety of benefits. These can be vouchers, discounted services, pre-sale promotions, exclusive events, prize draws or other interesting offers. The benefits depend on your individual status level. We reserve the right to change, add or restrict the content of the benefits. You can find an up-to-date list of all benefits that apply to you in your membership account.
(2) As a participant in the Jack Wolfskin Membership Programme, your orders and returns recorded in the official Jack Wolfskin online shop membership account are free of shipping costs.
(3) If you take part in the Jack Wolfskin Membership Programme, you can collect bonus points when shopping in the Jack Wolfskin online shop of the country in which registration for the Membership Programme took place. You must, however, identify yourself as a member before making your purchase in order to benefit from this. Furthermore, bonus points can be won in special time-limited promotions. Bonus points are transferred to the holder's membership account where they are stored and added up on an ongoing basis.
- COLLECTING BONUS POINTS AND REDEEMING BONUS VOUCHERS
(1) You will receive bonus points credited to your personal membership account (see section 3) for every purchase of goods eligible for bonus points in the official Jack Wolfskin online shop of the country in which you have registered for the Membership Programme. The number of bonus points is calculated from the respective purchase price of the goods eligible for bonus points, including statutory VAT (assessment basis). The purchase price is multiplied by 5 and then rounded up or down to a whole number. Exceptions may be time-limited promotions where you receive more or fewer bonus points (e.g. double points promotions). You will not be granted bonus points for the purchase of voucher and gift cards, services and items from third-party manufacturers or for any shipping costs incurred. Bonus points from purchases of goods count as "earmarked points” during the first 35 days after the purchase of goods. Your membership account will only be credited with these points after 35 days.
(2) If you cancel a purchase contract (return, complaint, etc.) where you have collected bonus points, the corresponding bonus points are deducted from your membership account.
(3) Bonus points can also be won in time-limited promotions. We may change, remove or add point-generating promotions at our discretion.
(4) Your bonus points are credited to your membership account and the amount is updated on an ongoing basis. You can check your points balance online by logging into your membership account. Bonus points expire after twelve (12) months. Bonus points may not be transferred to other members.
(5) Objections to the updated points total must be made in writing within two (2) weeks of becoming aware of the amount and by stating your Jack Wolfskin Member ID and enclosing the relevant proof of purchase. Failure to assert a claim in good time shall be deemed to constitute approval of the credited amount.
(6) Bonus points can be exchanged for bonus vouchers in set amounts of 500 bonus points collected. 500 points correspond to a voucher worth 5.00 currency units. The maximum redemption value per voucher is 20,000 points (200.00 currency units). The exchange only takes place in your membership account. Bonus vouchers are valid for 6 months after issue and must be entered correctly in the corresponding entry field in the official Jack Wolfskin online shop as part of the order entry process. Bonus vouchers can only be redeemed in the country in which registration for the Membership Programme took place. Each voucher featuring bonus points may only be redeemed once and for the amount specified on the voucher. If the voucher amount exceeds the purchase amount at the time of redemption, the residual voucher value expires. Only one voucher can be redeemed per purchase. A voucher cannot be combined with other vouchers or promotions. If the voucher is not redeemed within the validity period, it will automatically expire. No cash payout of the value specified on the voucher or any residual value remaining after offsetting the purchase value is permitted. It is not possible to redeem the voucher by telephone.
(7) In the event of a purchase contract being cancelled in its entirety (return, complaint, etc.) against which a bonus voucher was redeemed, the amount of bonus points corresponding to the bonus voucher will be credited back to your membership account.
(8) Accumulated bonus points are valid for 12 months as level points, which are used to calculate the individual('s) level. Even after exchanging bonus points for a voucher, these will remain as level points until the end of the validity period. Level points are used to calculate the individual level of the respective member.
- LEVEL AND LEVEL QUALIFICATION
(1) The Jack Wolfskin Membership Programme has three levels. Level 1 (hereinafter: “Valley”) is the level for members who have attained 0-2,499 level points. Level 2 (hereinafter: “Mountain”) is for members with 2,500-4,999 level points. Level 3 (hereinafter: “Peak”) is for members with 5,000+ level points. The Mountain or Peak level is reached by attaining the aforementioned number of level points within twelve (12) months. Once the Mountain or Peak level has been attained, this level remains valid for you for twelve (12) months. After twelve (12) months, your level will be recalculated based on your current number of level points.
(2) By reaching a higher level, you are entitled to new benefits. You can find an up-to-date list of all benefits applicable in your membership account.
(3) You can read about your current level and the associated benefits online in your membership account.
- USE OF YOUR DATA AND DATA PROTECTION
We will let you know about the processing of your personal data in your membership account under Data Privacy policy.
- CANCELLATION AND DELETION OF THE MEMBERSHIP ACCOUNT
(1) This agreement is concluded for an indefinite period. You may cancel your participation in the Jack Wolfskin Membership Programme at any time, without adhering to a notice period, by writing to Jack Wolfskin Retail GmbH, Jack Wolfskin Kreisel 1, 65510 Idstein/Ts., Germany or info@jack-wolfskin.com or cancelling it yourself in your member account Unredeemed bonus points expire when you leave the Jack Wolfskin Membership Programme.
(2) Jack Wolfskin may terminate this agreement at any time by giving one month's notice.
(3) If there is good cause, e.g. misuse of the Jack Wolfskin Membership Programme by the member, Jack Wolfskin may terminate the contractual relationship with you at any time without serving notice. Jack Wolfskin reserves the right to claim all damages for misuse of the Jack Wolfskin Membership Programme.
(4) If you have not collected any new bonus points during a period of ten (10) years and the membership account has not been used by you (i.e. inactive), Jack Wolfskin will delete your membership account without further notice. However, you may sign up again, free of charge, at any time.
- LIABILITY
(1) Jack Wolfskin assumes no liability for the availability of the Jack Wolfskin Membership Programme at any time or for the bonus point levels, information and offers being complete, accurate and up to date. The liability of Jack Wolfskin for the loss of vouchers containing the bonus points is excluded to the extent permitted by law.
(2) Furthermore, we shall only be liable for such damages that are based on an intentional or grossly negligent breach of duty by legal representatives or vicarious agents of Jack Wolfskin. This limitation of liability does not apply to damages resulting from injury to life, physical injury or health.
(3) We shall not be liable for simple negligence on the part of legal representatives and vicarious agents of Jack Wolfskin, unless a duty is breached whose fulfilment is of particular importance for achieving the purpose of the contract (hereinafter: “cardinal duty”). Cardinal duties are duties, the fulfilment of which are essential for the proper performance of the contract, whose breach jeopardises the achievement of the purpose of the contract and on whose compliance the other party to the contract regularly relies. In the event of a negligent breach of a cardinal duty, liability shall be limited to the foreseeable damage typical of the contract.
(4) Liability in accordance with the Product Liability Act shall remain unaffected.
(5) We expressly point out that the contractual provision of the offers and services of the membership account depends crucially on the truthfulness of your personal details. Liability for damages based on your incorrect or incomplete information is therefore excluded.
- FINAL PROVISIONS
(1) Jack Wolfskin reserves the right to discontinue the Jack Wolfskin Membership Programme, in whole or in part, at any time or to change its conditions, in particular if this is required by law or is necessary to improve processing or prevent misuse. Jack Wolfskin also expressly reserves the right to change the rules of the Membership Programme, rules governing the calculation of bonus points, redemption rules and rules pertaining to calculation of the different levels.
(2) You will be notified of any changes in writing to the last address provided as a message, by email or in your membership account, and this shall be deemed approved if you do not object to Jack Wolfskin within 30 days of receipt of the notification. If you object to changes, Jack Wolfskin will terminate your membership of the Jack Wolfskin Membership Programme. If you continue to use the Membership Programme after the deadline has expired, this is also deemed to be approval of changes made.
(3) This agreement on the Jack Wolfskin Membership Programme is subject exclusively to German law. If your domicile or habitual residence is in another EU country at the time the contract is concluded, the application of mandatory statutory provisions (in particular consumer protection regulations) of that other country shall remain unaffected by the aforementioned choice of law. All disputes arising from this agreement, including those concerning its valid conclusion and cancellation, shall be subject to the statutory place of jurisdiction.
